Fair Use assumes that the decision to use copyrighted material occurred too late to request permission to copy. Therefore, a teacher can use materials once under Fair Use. In order to use those same materials again, the teacher must pursue permisson or purchase.

Curriculum-writing teams may not assume that they have the same rights to materials as an individual classroom teacher.
Fair Use only applies in an individual teaching situation, not in any instructional activity/publication that has an audience beyond a single classroom.
